and/or your clients websites, but you may not sell/offer for free
our templates in any sort of collection, such as distributing to a
third party via CD, diskette, or letting others to download off your
websites etc.
If you download our free web templates then link back to
www.StarByDesign.com is required and always appreciated. Usage of
our free web graphics, banners, etc.. while is not required to link
back it is appreciated. Also, please visit the Link Us section.
The templates are offered "as is" without warranty of any kind,
either expressed or implied. StarByDesign.com will not be liable for
any damage or loss of data whatsoever due to downloading or using a
template. In no event shall StarByDesign.com be liable for any
damages including, but not limited to, direct, indirect, special,
incidental or consequential damages or other losses arising out of
the use of or inability to use the templates and/or information from
StarByDesign.com.
StarByDesign.com team reserves the right to change or modify these
terms with no prior notice.
StarByDesign.com currently allows you non-exclusive limited license
only. This effectively means that you can use the web templates and
other products sold through our web site (the "products") in
conformity with these Terms of Use and Conditions (the "license")
issued by StarByDesign.com.
UNAUTHORIZED USE
CD, DISKETTE & OTHERS: Please do NOT place any of our products on a
diskette, CD, website or any other medium and offer them for
redistribution or resale, without prior penned/written consent from
our company.
Any misuse or distribution of our templates, graphics (but not
limited to), may result in serious penalties. Our works are
original. We will do everything to protect our rights.
StarByDesign.com does NOT grant exclusive rights for the items
downloaded from our website, it does grant non-exclusive limited
license usage.
Ownership Conditions:
StarByDesign.com products are provided on "as is" basis without
warranty of any kind, either communicated or understood. Please
accept full responsibility to evaluate independently the accuracy,
completeness, quality and usefulness of any information or other
content as externally link or displayed in this website.
User/customer should understand that StarByDesign.com is not
accountable, and does not have any liability to any such user, with
respect to any information, product or service offered externally.
Refund Policy:
StarByDesign.com wishes to inform its users/customers that once an
item is downloaded we are unable to offer any refund. Refunds are
negated as per company policy and any such claims will be granted
entirely at the discretion of the admin of Starbydesign.com
Member Access and Downloads:
As a member your username and password is for your personal use only
not to be shared. Premium membership consumers may not "share"
accounts, in the event customer/member wishing to obtain access for
friends/family/employees etc.. must purchase separate membership
license for each person to access this restricted membership area.
Premium members as with any other fore mentioned consumer, may not
redistribute any portion for resell via website, diskette etc... or
offer for download contents of restricted membership areas whether
for monies or other. You as an upgraded/premium paying member agree
NOT to redistribute or resale products/digital goods obtained by
said membership. Failure to comply may result 1) removal of account
with forfeiture of monies paid for said membership 2) possible
legal action per Starbydesign.coms admin discretion.
You are also not allowed to use a spider, web crawler, or other same
automated tools to download the content from our site.
Governing Authority:
In the event of disputes of every nature, with regard to any
services offered by StarByDesign.com or any term listed in this
policy, the only jurisdiction that shall be applied in ascertaining
liability is the court situated in Moore County located within the
state of North Carolina, USA. The plaintiff in this case a
user/customer of StarByDesign.com must understand that he/she will
have to agree to compensate StarByDesign.com for its legal fees,
costs and disbursements in an event that it is obligated to go to
court, rather than arbitration if StarByDesign.com is successful.
This process might be taken by StarByDesign.com to enforce any of
its rights, or to collect any fees.
Severability:
This clause allows that any portion or term of this agreement if
found to be unenforceable will not affect the validity of the rest.
This means that the agreement will remain effective and enforceable
on its remaining terms and conditions.
